NPA tops the list of the rogues gallery of South Africa's statutory bodies

In a decision on 8 March 2019 the South African Human Rights Commission (SAHRC) has dismissed the FW de Klerk Foundation's November 2016 complaint against EFF leader Julius Malema that his white slaugher comments did not constitute hate speech.

Malema said: “White people found peaceful Africans here. They killed them. They slaughtered them like animals. We are not calling for the slaughtering of white people, at least for now. What we are calling for is the peaceful occupation of land and we don’t owe anyone an apology for that.” 

This is legal and political finessing. Had the roles been reversed - a white making those comments about blacks - the SAHRC would have immediately found it racist and hateful, and not taken over two years to do it.

There is a perception the SAHRC is obsessed by white-on-blacks racism and alleged racism, is not independent and too tuned into the country's ANC and EFF-led political narrative of black victimisation. This decision confirms it.

I have experience of them as a complainant and found them incompetent, disinterested and unwilling to investigate and too credulous when it comes to questioning and accepting government's or the authorities', replies. They 'lost' my sworn statement and supporting documents that proved my complaint, accepted the lies told by a mendacious WC - the respondent - official and promptly closed the case without investigating. They said I could appeal but replied to it. Instead, when I managed to get through to them, a Cape Town office staff member irritatedly told me they were at a staff development function in Hermanus and couldn't deal with my issues. As a matter of interest, the then head was later made a judge. Such is the standards of this country.

But they're not the country's only statutory body that's dysfunctional, inept, captured and/or abdicated it's constitutional and legal obligations. The rogues gallery I've personally experienced are:
  • Auditor-General (twice);
  • Cape Law Society (twice);
  • Cape Town Director of Public Prosecutions (NPA) (twice)*;
  • Finance Sector Conduct Authority;
  • Health Professions Council of SA (three times, twice same case)*;
  • Public Protector (twice, same case);
  • SA Human Rights Commission;
  • SA Police Service (criminal and poor service complaints, both at least twice)*;
  • SA Veterinary Council;
  • And pending, Office of Health Standards Compliance aka Health Ombuds*.
(* Recent cases within the past year)

Except FSCA and SAVC, most of these referrals had a political/government angle or connection. This list doesn't include the legion of government departments at national, provincial and local people deal with daily.

All are worthy but the overall winner and most egregious must be the DPP/NPA and runner-up, SAPS. With these buffoons responsible for criminal justice, it's no wonder the crime rate is so high. There's a slim chance of offenders being investigated, arrested and prosecuted, i.e. if NPA/SAPS haven't pre-emptively and a priori dismissed/ignored the complaint/complainant, a common practice. The inmates have taken over the prison/asylum.

These two agencies are primarily responsible for upholding the law and defending the constitution and citizen's rights but they display an alarming lack of knowledge of the letter and spirit of the law, are grossly incompetent and subject to amazing levels of political interference and self-abasement and grovelling in that regard.

Therefore, it's no surprise that with this prevalent culture of lawlessness the country's other regulatory and statutory bodies shall follow suit in their own way. They're not there to uphold the law, standards, defend citizen's rights and investigate and sanction offenders, but allow them to get away, sometimes literally with murder especially if they're connected or involved with politics or government at any level. 

Ironically, they and their political puppet masters continually urge citizens to be good and obey the law. Humbug.
